Southern Poverty Law Center Sues for Teacher’s Free Speech Rights in Controversial Case

The Southern Poverty Law Center (SPLC) has taken a significant step by filing a lawsuit on behalf of Michelle Mickens, a teacher from Oglethorpe County High School in Georgia. This legal action supports Mickens, who expressed her belief that the world is "a bit safer without" Charlie Kirk, the founder of Turning Point USA, who was tragically assassinated in September.

Mickens, recognized as a finalist for the 2022 Georgia Teacher of the Year, made her remarks in response to Kirk’s death, highlighting the epidemic of gun violence in the country. In her post, she stated, “While I’m sad that we live in a country where gun violence is an epidemic, the world is a bit safer without him. I didn’t respect him at all, and he’s part of the hatred and vitriolic language we hear so much now. I pray that without him, people can be kinder and more tolerant to one another.”

Following her comments, the SPLC and the Georgia Association of Educators alleged that Mickens’ First Amendment rights were violated when she was placed on indefinite leave and urged to resign. The lawsuit claims that her personal social media expression, concerning a matter of public interest, was protected speech.

The controversy escalated when a former classmate of Mickens took a screenshot of her post and shared it, eventually reaching her school. The lawsuit argues that Mickens’ post did not disrupt school operations; rather, her removal from the classroom was the primary disruption. The complaint states, "The decision to remove Ms. Mickens from her classroom has been the only disruption to the school’s operations."

The SPLC is advocating for Mickens’ reinstatement, compensation for lost wages and benefits, emotional distress, and coverage of legal fees. Michael Tafelski, interim deputy legal director at the SPLC, emphasized the importance of this case in resisting ideological control over public education. He stated, “Ms. Mickens is being targeted not because she violated any policy or harmed students, but because her personal views — expressed outside of the classroom — don’t align with those in power.”

In response to the lawsuit, Beverley Levine, the superintendent of the Oglethorpe County School System, indicated that the district is aware of the suit and believes many facts presented are inaccurate or incomplete. She expressed confidence in the district’s position, stating, "The District prefers to litigate the issues in that forum and not in the press or in the public."

This case raises important questions about free speech rights for educators and the implications of personal beliefs in the workplace. As the SPLC prepares to defend Mickens, the outcome could have far-reaching effects on the intersection of education, personal expression, and constitutional rights.
