In a significant ruling, a federal judge in Oregon has permanently barred the deployment of national guard troops in Portland, effectively halting the Trump administration’s plans to send federalized troops to the city. U.S. District Court Judge Karin Immergut issued her order just moments before a temporary restraining order was set to expire.
Immergut, appointed by Trump during his first term, previously ruled that the president’s claims of Portland resembling a war zone due to a small protest against immigration raids were “unfounded and disconnected from reality.” The City of Portland and Oregon’s attorney general had filed a lawsuit in September, arguing that the Trump administration exaggerated the protests’ scale and nature to justify troop deployment under a law reserved for cases of rebellion.
In her detailed ruling, Immergut highlighted that while there were instances of violence in June, the protests outside the Portland ICE facility have largely been peaceful since then. She noted only isolated incidents of minor violence, mainly between protesters and counter-protesters. Considering the prevailing conditions leading up to the president’s decision to federalize the National Guard, Immergut concluded there was no lawful basis for the action.
During the trial, it was revealed that local police observed protesters in non-threatening inflatable costumes and participating in festive activities such as dance parties. While the ruling may not extend to enjoining Trump’s actions directly, it does prevent Defense Secretary Pete Hegseth and Homeland Security Secretary Kristi Noem from carrying out orders related to troop deployment in Oregon.
Immergut also issued a temporary stay on the federalization of the Oregon National Guard for 14 days, maintaining the current status where national guard members are federalized but not actively deployed. The Trump administration is expected to appeal this decision, potentially escalating the case to the Supreme Court.
